Acceptance

All bookings accepted by Villa Blu are subject to these Terms and Conditions that are deemed to have been accepted  in full by the guest. Payment of a booking fee or rental charge as so indicates acceptance or these Terms and Conditions.

General

Renting serviced units from Villa Blu is not intended to confer possession on the guest or to create the relationship of landlord and tenant between us and the guest. The guest will not be entitled to any form of tenancy. The Guest confirms that they will not be occupying the serviced unit as their only or principal home.

Reservations & Payment

Your booking is only confirmed when we e-mail written confirmation of booking following receipt of payment of the booking fee. When a booking is made, 50% of the total Rental Charge (Booking Fee) is required wIthin 48 hours of making the reservation in order to confirm the reservation.The balance (if any), of the Rental Charge is to be paid 30 days prior to the arrival date. If we do not receive full payment by this time, the reservation may be cancelled and the deposit forfeited. The Guest may be liable for the balance of the Rental charge and for any other costs involved in the attempt to re-let the serviced unit. When a booking is made less than 30 days prior to the arrival date, the full Rental Charge is required to confirm the reservation. Guests wishing to extend their stay are required to give at least 7 days notice, subject to the room or an alternative being available. Payment must be made in South African Rand (ZAR) and must be clear of all bank charges, exchange rate variations and any other deductions.

We accept the following methods of payment: bank to bank bank transfer (EFT) to our account. A payment link is also available on our website.

Under no circumstances will accommodation be provided until we have received cleared funds to cover the Rental Charge. Failure to pay in accordance with the agreed terms of payment may result in suspension of accommodation. We reserve the right to charge interest on overdue accounts at 4% per month or part thereof and to seek payment in full for accommodation during the suspension period. All rates are strictly as set out on our website inclusive of Value Added Tax (VAT) levied at the current rate.

Cancellation Policy

  • Only written cancellations will be accepted, which will be acknowledged by our reservations office
  • 50% of the total payment is payable if the reservation is cancelled 14-30 days prior to arrival.
  • 100% of the total payment is payable if the reservation is cancelled less than 14 days prior to arrival.
  • Should you not arrive on the date you have booked, and have not cancelled your booking in writing, you will be debited with a no-show fee of 100% of your reservation fee.

A change of arrival date or departure date by the Guest may be treated as cancellation and re-booking. Villa Blu recommends that the Guest insures against cancellation.

Arrivals & Departures

Rooms are available for occupation between 14h00 (2pm) and 18h00 (6pm) on the day of arrival, should you not be able to check-in during this time, please contact us to arrange a late-arrival check-in. Rooms must be vacated and keys returned by 10:30 on the day of departure.

Accommodation Charges

Accommodation is self catering and the Villa will be serviced daily from Mondays to Saturdays. Services on Sundays and public holidays will be charged extra. Linen and towels will be changed at the discretion of management. Our minimum length of stay is 2 nights, with no maximum. The minimum length of stay over December peak season is 14 days.

Occupants

Only guests specified by name at the time of booking by the guest may occupy the rooms. The Guest must not assign, sublet or part with or share possession of the serviced unit or any part of it. Villa Blu reserves the right to refuse admittance to the Guest if they are in breach of this condition.

Keys

Keys will be provided for the serviced units and are to be returned in line with the departure terms as above.

For any keys not returned, there will be a replacement charge. If the Guest loses or misplaces their keys during occupation and requires assistance to gain entry, an additional charge will be made.

Broadband

Broadband internet access is provided in all serviced units. Although we will endeavour to assist with an connection problems Villa Blu accepts no responsibility for the inability to connect to this facility.

Property Use & Conditions

The Guest is responsible for taking all reasonable care of the serviced unit and its contents. The serviced unit and all equipment, utensils, furniture etc. must be left clean and tidy at the end of the Rental Period. No items may be removed from the serviced unit. Except in the case of normal wear and tear the Guest will be responsible for making good any damage to the serviced unit or its contents which has occurred due to negligence, willful damage or irresponsible behaviour on the part of the Guest or their visitors. Such damage must be reported to us without delay. In the event that breakages or damage are discovered or extra cleaning required, after departure, we will notify the Guest in writing within 7 days of departure, providing detail of the issues and an invoice for the cost of rectifying them. Villa Blu will not be held responsible for any personal injury, loss or damage to personal effects howsoever arising at the serviced unit or in the unit block or its grounds. Smoking is not permitted in the rooms or breakfast room. Smoking is permitted at our braai and pool area. Pets are not allowed.

A refundable breakage deposit equivalent to one night stay will be required on booking.

Complaints

Any complaints must be made in writing immediately to Villa Blu. We shall not have any liability for any complaint received after the completion of the Rental Period.

Liability and Indemnity

Guests bear the sole and absolute responsibility for ensuring it is aware of the Villa Blu’s liability and indemnity clause.

All persons entering the Villa Blu property and/or using any facility and/or participating in activities on the property, do so entirely at their own risk. Villa Blu,its employees, agents, representatives, subsidiaries, affiliates, controlling or holding company and insurers, past and present, will not be liable or responsible for any personal injury, harm, death, loss of support or damages of any nature whatsoever, whether arising from negligence or any other cause whatsoever.

Without derogating from the generality of the aforegoing, parents and guardians who enter the premises do so on the basis that they assist any child accompanying them, in contracting as aforesaid and undertake to indemnify, hold harmless and absolve Villa Blu from any and all claims whatsoever that may rise in connection with any personal injury, harm, death, loss of support or damages of any nature whatsoever, whether arising from negligence or any other cause whatsoever, suffered by any such child.

Guest will indemnify, defend, and hold Villa Blu harmless from any and all damages claimed by any third party against Villa Blu relating to or arising from the agreement or provision of the services.

 Force Majeure

Villa Blu will not be liable for any failure to fulfil its obligations under this agreement if and to the extent such failure is caused by any circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, earthquakes, fire, explosions, floods, hurricanes, extreme weather, riots, wars, hostilities, revolutions, civil disturbance, sabotage, nuclear incidents, epidemics, strikes over which it has no control.
